User Agreement
Your use of YPNation indicates your agreement to the below terms. YPNation reserves the right, at its sole discretion, to modify or replace the User Agreement at any time.
Use of Content
Attribution Non-Commercial
Under a Creative Commons Attribution Non-Commercial License, YPNation permits anyone to do the following with original YPNation content, in any medium:
- to reproduce quotes
- to reproduce screenshots of any page of YPNation
- to include original YPNation material in mash-ups, mixes, parodies, caricatures, etc for movies, TV, print or online
**NOTE** this does not include the right to republish images from YPNation, for which YPNation may not the copyright holder, except in the context of a screenshot of the whole site.
YPNation makes no representations or guarantees about the suitability for third-party use of content that appears on YPNation, and licenses herewith only the content of which YPNation is the copyright holder.
RSS feeds
YPNation provides a general license to use RSS feeds as detailed below, provided that they are not modified:
- The RSS feeds may not be spliced into or otherwise redistributed by third-party RSS providers.
- No content, including any advertisements or other promotional content, shall be added to the RSS feeds.
- YPNation reserves the right to object to your presentation of the RSS feeds and the right to require you to cease using the RSS feeds at any time.
- YPNation further reserves the right to terminate its distribution of the RSS feeds or change the content or formatting of the RSS feeds at any time without notice to you.
Web Syndication
Internal links in the Site content must not be removed.
The Site logo and/or URL should appear on each page displaying site content.
The format or branding of the headlines, text and other information provided in the RSS feeds must not be modified.
"More From…" links back to original Site at the end of each post must be included on content pages and may not be removed.
Reproduction of screenshots from YPNation is permissible, without prior written approval, so long as the site logo and URL is fully visible or otherwise included on the page. See above for general permissions on partial content.
The Site logo and URL must appear prominently at the top of each section displaying site content.
Content must appear unedited, except for replacement of hyperlinks with full URLs and use of product manufacturer's site links where appropriate.
Images from a Site must not be used in print without you obtaining the appropriate copyright clearances yourself.
General
YPNation provides this content "as is" and YPNation shall not be held liable for your use of the information or the feeds.
Use of a Site's content, including text and images, on your site, or in print, is entirely at your discretion. YPNation is not responsible for any complaints regarding content or images that you choose to display on your site or in print.
TO THE FULLEST EXTENT ALLOWED, YPNATION DISCLAIMS
Corresponding with YPNation
Any correspondence with YPNation, including any documentation or images, are considered property of YPNation. YPNation reserves the right to reproduce such correspondence, in whole or in part, on YPNation or any of its affiliates.
As a condition of use, you promise not to use the Services for any purpose that is unlawful or prohibited by the User Agreement, or any other purpose not reasonably intended by YPNation.
By way of example, and not as a limitation, you agree not to use the Services:
- to abuse, harass, threaten, impersonate or intimidate other YPNation users;
- to post or transmit, or cause to be posted or transmitted, any Content that is infringing, libelous, defamatory, obscene, pornographic, abusive, offensive, profane, or otherwise violates any law or right of any third party;
- for any illegal or unauthorized purpose. If you are an international user, you agree to comply with all local laws regarding online conduct and acceptable content;
- to post or transmit, or cause to be posted or transmitted, any communication or solicitation designed or intended to obtain password, account, or private information from any YPNation user;
- to create or submit unwanted email ("Spam") to any other YPNation users or any URL;
- to violate any laws in your jurisdiction (including but not limited to copyright laws);
- to submit content or comments linking to affiliate programs, multi-level marketing schemes, sites/blogs repurposing existing stories (source hops), or off-topic content;
- with the exception of accessing RSS feeds, you will not use any robot, spider, scraper or other automated means to access the Site for any purpose without our express written permission. Additionally, you agree that you will not: (i) take any action that imposes, or may impose in our sole discretion an unreasonable or disproportionately large load on our infrastructure; (ii) interfere or attempt to interfere with the proper working of the Site or any activities conducted on the Site; or (iii) bypass any measures we may use to prevent or restrict access to the Site;
- with the intention of artificially inflating or altering the 'Rate count', blog count, comments, or any other YPNation service, including by way of creating separate user accounts for the purpose of artificially altering YPNation's services; giving or receiving money or other remuneration in exchange for votes; or participating in any other organized effort that in any way artificially alters the results of YPNation's services;
- to advertise to, or solicit, any user to buy or sell any products or services. It is also a violation of these rules to use any information obtained from the Services in order to contact, advertise to, solicit, or sell to any user without their prior explicit consent;
- attempt to impersonate another user or person;
- sell or otherwise transfer your profile.
IN ADDITION, YOU HEREBY AGREE THAT YOU SHALL NOT USE THE SERVICE (INCLUDING, WITHOUT LIMITATION, BY "RATING" ANY CONTENT) ON BEHALF OF (OR
YPNation may remove any Content and user accounts at any time for any reason (including, but not limited to, upon receipt of claims or allegations from third parties or authorities relating to such Content), or for no reason at all. To report Terms of Use abuse, please email: abuse@YPNation.net.
You are solely responsible for your interactions with other users of the Site. YPNation reserves the right, but has no obligation, to monitor disputes between you and other users.
Image and Video
- Material licensed from photographic archive and video vendors
- Material supplied to our editors or released into the public domain by public relations and marketing companies for press purposes
- Reader-submitted Material, with the implied representation that the person submitting the material owns the copyright in the material and the right to give it to us for use on our site(s)
- Material published on public photo/video sites with licenses granted under Creative Commons, with attribution in accordance with the CC license granted in each case
- Material commissioned by YPNation
- Material that we believe to be covered by the Fair Use Doctrine, taking into account factors such as:
The purpose and character of the use (i.e. transformation from the original, use for criticism, satire or parody)
The nature of the copyrighted work (i.e. factual or newsworthy vs creative works)
The amount and substantiality of the portion used in relation to the whole (i.e. use of cropped, reduced, low-resolution Material used for no more than to convey the point made)
The effect on the potential market for the copyrighted work (e.g. use that is not substitutive for the original, or would never be licensed in any event)
If YPNation receives notice that Material posted is not in keeping with these terms and conditions or the intended use of the Comments section where it is posted, we reserve to right to remove the material.
If you think we have published Material that infringes your copyright, we will address your concerns; however, if the material falls into one of the categories listed above, we believe that our use is legitimate and we will not remove it from the site.
Please note that we will respond only to notices of alleged infringement that comply with the Digital Millennium Copyright Act. The text of the Act can be found at the U.S. Copyright Office Web Site, http://lcWeb.loc.gov/copyright/.
Indemnity
You will indemnify and hold harmless YPNation, its parents, subsidiaries, affiliates, customers, vendors, officers and employees from any liability, damage or cost (including reasonable attorneys. fees and cost) from (i) any claim or demand made by any third party due to or arising out of your access to the Site, use of the Services, violation of the User Agreement by you, or the infringement by you, or any third party using your account or YPNation User ID, of any intellectual property or other right of any person or entity.
